Nottingham murderer’s sentence referred to Court of Appeal by Attorney General

Relatives of the victims of Nottingham triple murderer Valdo Carocane said they were “extremely pleased” his sentence would be reviewed, hoping the court would respond to their calls for justice.

Attorney General Victoria Prentice on Tuesday confirmed the sentence would be referred to the Court of Appeal for reconsideration after concluding it was “unduly lenient”.

Last month, Karokane was accused of stabbing to death university students Barnaby Webber, 19, Grace O’Malley Kumar, 19, and school janitor Ian Coates, 65, in the early hours of June 13 last year. He was given an indefinite hospitalization order.

He also ruled for the attempted murder of three people who were run over by the van he stole from Mr Coates after Nottingham Crown Court heard that Mr Coates had been diagnosed with paranoid schizophrenia. He admitted and pleaded guilty.

The victim’s relatives reacted angrily to the verdict after prosecutors decided not to pursue murder charges.

In a statement, loved ones of Mr. Webber, Mr. O’Malley Kumar, and Mr. Coates said: It killed our loved ones, it was wrong.

“We are optimistic that when this matter goes to the Royal Court of Justice for appeal, we will get an outcome that provides some of the appropriate justice that we have been seeking.”

The family said the attorney general’s decision was based on an “insufficient investigation” into Karokane’s liability, a minimum requirement that did not take into account “planning” or “premeditation” of the attack, and that the hospital’s order was said to be “inadequate”. It should have involved an additional “penal” element under the Mental Health Act. If he is deemed fit to be discharged, he could spend some time in prison for the crime.

Mr Prentice said Mr Carrocane’s crime was “horrific” and had “shocked” the nation, adding that the victim’s loved ones had shown “immeasurable strength during this devastating time”. I praised him for that.

“This is a case that has aroused strong emotions among so many people and I have received so many referrals under an unduly lenient sentencing scheme to consider the hospital order made in Calokane.” It was no surprise that we received ,” she said.

Mr Prentice, who had received “detailed legal advice” and considered the issues raised “very carefully”, added: The matter will be referred to the Court of Appeals. ”

The attorney general’s office did not say how many requests to review the sentence had been received, but stressed that only one referral is required for a case to be considered.

The families stressed that while investigations into the actions of police, prosecutors and mental health staff continue, this is “just part of the tragic failures in this case” and that the “serious failures” will be “fully addressed”. ”, he asked again.

“Organizational and individual accountability must be taken and appropriate changes made where relevant,” their statement added.

The comments come as the CPS watchdog widens its investigation to examine not just the area surrounding the attack, but all interactions between Mr Calocane and prosecutors after an independent inquiry was ordered by Mr Prentice. Police watchdog the Independent Office for Police Conduct (IOPC) has launched an investigation into contacts between police officers in Nottinghamshire and Leicestershire with Calokane.

Health Secretary Victoria Atkins has asked healthcare watchdog the Care Quality Commission (CQC) to carry out an investigation into Nottinghamshire Healthcare Foundation Trust, which provided care for Mr Cullocane. The results are expected to be announced next month.

Downing Street has previously said it has not ruled out launching a public inquiry to consider claims the government missed an opportunity to stop Karokane before he was killed, amid growing calls for a wider investigation. However, no such research has been published so far.
